Terms of Service

By accessing or using the VAPT Insights platform at vaptinsights.com (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not access or use the Service.

These Terms constitute a legally binding agreement between you (or the organisation you represent, "you") and VAPT Insights ("Company", "we", "us", or "our").

VAPT Insights provides a cloud-based security scanning, Software Bill of Materials (SBOM) management, and vulnerability analysis platform. The Service includes:

• Automated dependency vulnerability scanning and SBOM generation.
• Security header analysis and SSL/TLS certificate inspection tools.
• Free in-browser SBOM viewer and analysis tools.
• Dashboard, reporting, integrations, and API access.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

• You must be at least 16 years of age to use the Service.
• You must provide accurate, complete, and current registration information.
• You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
• You must notify us immediately at [email protected] upon becoming aware of any unauthorised use of your account.
• One person or legal entity may not maintain more than one free account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to scan, probe, or test systems you do not own or do not have explicit written authorisation to test.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Introduce malware, viruses, or other malicious code into the platform.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Violate any applicable local, national, or international law or regulation.
• Resell, redistribute, or sublicense access to the Service without our prior written consent.
• Use the Service in any manner that could impair performance or availability for other users.
• Scrape, crawl, or use automated means to access the Service beyond normal API usage.

• Paid plans are billed on a monthly or annual basis as selected at checkout.
• All fees are non-refundable except as required by applicable law or expressly stated in our refund policy.
• We use Stripe for secure payment processing. By subscribing, you authorise us to charge your payment method on a recurring basis.
• We may change pricing with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.
• Failure to pay may result in suspension or termination of your account.

We may offer a free tier or trial at our discretion. Free tier usage is subject to fair-use rate limits. We reserve the right to modify or discontinue the free tier at any time with reasonable notice. Abuse of the free tier (e.g., creating multiple accounts to circumvent limits) may result in immediate account termination.

7.1 Our Property

The Service, including its software, design, trademarks, and content, is owned by VAPT Insights and protected by intellectual property laws. Nothing in these Terms grants you ownership of our intellectual property.

7.2 Your Data

You retain full ownership of all data, SBOM files, scan results, and content you upload to the Service ("Your Data"). You grant us a limited, non-exclusive licence to process Your Data solely as necessary to provide the Service to you.

7.3 Feedback

Any feedback or suggestions you provide about the Service may be used by us without any obligation to you.

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. We implement industry-standard security controls to protect your data. See our Trust & Security page for full details.

Each party agrees to keep confidential any non-public information received from the other party that is designated as confidential or should reasonably be understood to be confidential. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Security scan results are provided for informational purposes only and do not constitute professional security advice. You are solely responsible for acting on scan findings appropriately.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VAPT INSIGHTS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

You agree to indemnify, defend, and hold harmless VAPT Insights and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any unauthorised scanning activity conducted using the Service.

Either party may terminate the agreement at any time. You may cancel your account from your account settings dashboard. We may terminate or suspend your account immediately without notice if you violate these Terms. Upon termination:

• Your access to the Service will cease immediately.
• Your data will be deleted within 30 days as described in our Privacy Policy.
• No refunds will be issued for any unused portion of a paid plan, except as required by law.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to binding arbitration.

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email to registered users or a prominent notice on the Service. Continued use of the Service after the effective date of any change constitutes your acceptance of the updated Terms.

• Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and VAPT Insights regarding the Service.
• Severability — If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver — Our failure to enforce any provision shall not constitute a waiver of our right to enforce it in the future.
• Assignment — You may not assign your rights under these Terms without our prior written consent.
